We advise on drafting policy language and coverage issues raised by claims. We monitor claims and prosecute declaratory judgment actions seeking judicial confirmation of coverage positions and defend breach of contract and bad faith actions for our clients. We have addressed coverage issues involving: the timing of actual or potential claims; the effect of untimely notice under variants of claims-made policies; related claim language and its effects; capacity issues; damages and disgorgement; and various exclusions including the insured v. insured exclusion.
We represent our insurance clients in coverage litigation in both state and federal courts nationwide and have secured judgments on among the first matters upholding the regulatory exclusion and addressing the scope of the defense obligation. Claims often do not lend themselves to immediate resolution through the court system, and insurers occasionally need representation to monitor the underlying claim litigation and to participate in alternative dispute resolution fora. We have extensive experience in this area whether or not related coverage litigation is pending.
