Patterson Comments on BlackBerry Case

"Outcome of BlackBerry Case Remains Anyone's Guess", IP Law360

January 30, 2005

Scott D. Patterson, a Partner and Co-Chair of the Technology Transactions and IP Practice Group, was quoted in IP Law360, a daily newswire for IP professionals. Mr. Patterson, who works in the Firm's Chesterbrook office, commented that despite the recent U.S. Supreme Court decision to strip Research In Motion Ltd. (RIM), the maker of the BlackBerry, of any options short of a settlement with NTP, an intellectual property holding company, RIM isn't quitting just yet.

“This is like watching a staredown in the World Series of Poker – both sides keep pushing more chips into the pot,” Mr. Patterson said. “If NTP cripples BlackBerry, a potentially huge future royalty gets wiped out. RIM, on the other hand, is seeing revenue losses from potential customers who aren’t buying new units while they wait for this litigation to be resolved. Both sides have shown a lot of nerve so far.”
